Explosives Licence Variation: What It Is and How to Apply

Merseyside Fire and Rescue Service (MFRS), are the Licensing Authority for the Explosives Regulations 2014 and Firework Regulations 2004, acting on behalf of the Merseyside Fire Rescue Authority. If you hold an explosives licence and need to make changes to its conditions, you may require a variation to your existing licence. This page explains what a variation to an explosives licence is and provides guidance on how to apply.

What is a Variation to an Explosives Licence?

A variation to an explosives licence is a formal change to the conditions or details of an existing licence issued by MFRS. This could include:

  • Changes to Storage Arrangements: Modifying the location, quantity, or hazard type (e.g., HT3 or HT4) of explosives stored at your premises.
  • Changes to Premises Details: Updating the address of the site or the licensee’s contact information.
  • Changes to the Licensee: Transferring the licence to another company or updating the licensee’s name.
  • Adjustments to Quantities or Types: Increasing or decreasing the Net Explosive Content (NEC) or changing the type of explosives (e.g., fireworks, pyrotechnics, or small arms ammunition) stored or manufactured.

A variation is necessary to ensure your licence remains compliant with the Explosives Regulations 2014 and reflects your current operations. Storing or selling explosives without a valid, up-to-date licence is an offence and may result in prosecution.

When Might You Need a Variation?

You may need to apply for a variation if:

  • You plan to store a different quantity of explosives (e.g., increasing from 75kg to 250kg NEC for HT4 fireworks).
  • You are relocating your storage facility or modifying the storage area within your premises.
  • You wish to store a different hazard type (e.g., switching from HT4 to a mix of HT3 and HT4).
  • There are changes to the ownership or tenancy of the premises where explosives are stored.
  • You need to update the licensee’s name or transfer the licence to another company.

Note: An application for a variation of an explosives licence held by an individual may be submitted to update specific details of the existing licence. However, if the variation involves a change of the licensee’s name, this will be treated as a new licence application. Applicants must provide all necessary documentation, including proof of identity and any additional information required to meet regulatory standards.

How to Apply for a Variation to an Explosives Licence

To apply for a variation to your existing explosives licence with MFRS, follow these steps:

  • Complete the Application Form and submit supporting documentation.
  • Site and Floor Plans: If the variation involves changes to the storage or sales area, submit updated site and floor plans. For example, if you are storing or displaying fireworks on a shop floor, include a floor plan of the sales area.
  • Risk Assessment: Submit a site-specific risk assessment for the storage of explosives, as required under the Dangerous Substances and Explosive Atmospheres Regulations 2002 (DSEAR). An example risk assessment can be found on the HSE website.

Pay the Application Fee:

An administrative fee may apply for processing a variation. Contact our team at explosivelicences@merseyfire.gov.uk for details on the applicable fee. Fees are non-refundable once the application is accepted. Payment is via online only.

Submit Your Application:

Allow up to 21 working days for processing. During periods of high demand (e.g., before seasonal firework sales), processing may take longer, so apply early.

Prepare for Inspection:

For significant variations (e.g., changes to storage arrangements or premises), MFRS may conduct a site inspection under the Regulatory Reform (Fire Safety) Order 2005 to ensure the premises are suitable.
